Will DWP’s ‘human rights’ appeal against Bedroom Tax defeat cause clash with UN?

That most litigious of government departments, the DWP, is at it again – trying to overturn yet another defeat of its inhumane and homicidal policies.

This time, lawyers for the Department are trying to claim that a first-tier tribunal did not have the power to rule that the Bedroom Tax discriminated against people who need an extra bedroom because of disability, because it interfered with their human rights.

This is, of course, also an act of defiance against the United Nations, which has ruled that the UK’s treatment of disabled people amounts to “grave and systematic violations” of their human rights.

This Writer certainly hopes someone acting for the Carmichaels has the presence of mind to raise this issue during the DWP’s appeal.

A couple who defeated the government in court over the bedroom tax are being forced to appear before a judge again, in a move which could have major implications for future welfare appeals.

The Supreme Court found in favour of Jayson and Charlotte Carmichael in November, after they claimed the bedroom tax discriminated against people who needed an additional bedroom because of a disability.

The defeat forced the Department for Work and Pensions (DWP) to amend the rules and led to celebrations from campaigners, but the DWP now appears to be challenging the legal route the family used.

The DWP is now arguing that the first tier tribunal didn’t have the right to rule on human rights grounds in the first place.

    You would think the nomenclature Supreme court would give some sort of pointer to their being able to decide on whether it was legal to use them or not and that their decision would be final. The DWP are apparently asking a court to decide whether it was right to make a decision only it has at the legal right to decide is a legal considered decision.

    What a bunch of gross lizards……The recent legal sucess for common sense, to now be challenged again is a complete waste of even more public money fighting this sensible decision. By the time these DWP idiots have finished they will have wasted far more money than just giving ground and allowing specific deserving cases to retain their benefits. Why don’t the DWP just slither back under their slimey rocks.

    Haven’t these poor people been through enough already. The DWP must get gratification in causing as much distress and stress as possible. They definitely want their pound of flesh and then some. I suppose they have to get their money from somewhere now they have u turned on the self employed tax rate.

    There’s no limits to the depths of the Government’s poisonous vindictiveness against disabilities. Yet the mighty white van man can make the Government u turn with full media backing.

    Under Articles 2 & 4 of the Convention for the Prevention and Punishment of the Crime of Genocide, we have EVERY RIGHT, for violations of Articles 23 & 25 (as well as several other violations), of the Universal Declaration of Human Rights, to hold EVERY SINGLE INDIVIDUAL RESPONSIBLE for this Crime Against Humanity to account in a International Court, for Crimes Against Humanity!

    We won in Supreme Court, 7 Judges to nil. I started the tribunal process just to get justice, and got it in both the first tribunal and the Supreme Court. They are now presenting tecnical arguments to defeat justice and keep the Human Rights act out of just about every kind of Welfare tribunal if they win this hearing
