Leading human rights lawyer takes on criminal case against IDS and Grayling over alleged harm to the disabled
The Black Triangle campaign in defence of disability rights has hired human rights solicitor Aamer Anwar to act in its legal battle against Iain Duncan Smith and Chris Grayling.
Black Triangle alleges that the former Work and Pensions ministers neglected their duty of trust to a degree that amounts to criminal misconduct according to Scottish law, which differs from the rest of the UK.
The case alleges that the two government ministers failed to address a coroner’s concerns about the safety of the “fitness for work” test – a failure which may have caused “countless deaths”.
A statement by Black Triangle’s John McArdle reads as follows:
I hereby mandate in full Solicitor Advocate Mr. Aamer Anwar, Aamer Anwar & Co. 63 Carlton Place, Glasgow, Lanarkshire G5 9TW to act on my behalf and represent me in the conduct and liaison with Police Scotland – and all other interested parties to the case as Mr. Anwar should so decide – to undertake all matters arising in the matter of my complaint on behalf of the Black Triangle Campaign in Defence of Disability Rights concerning the alleged criminal misconduct by the named former U.K. ministers at the Department of Work and Pensions in violation of the following offence at Scottish criminal law:
‘It is a crime at common law for a public official, a person entrusted with an official situation of trust, wilfully to neglect his duty, even where no question of danger to the public or to any person is involved.’
Gordon, Criminal Law, 3rd Ed. Vol. II Chapter 44. q.v.

good, about time.
Will be keeping a close watch on how this progresses. One can only hope the momentum doesn’t stop north of the border.
I hope no stone’s left unturned and eventually the truth will come out so that the whole country will finally realise what’s been happening the last 6 years to the poor, the disabled, the sick and the unemployed..
Good Luck Black Triangle
and God Bless
At last!
High time the grim reapers were brought to heel!
love to see these two low lifes in the dock.
And so, it begins.
I suspect Smith thought himself safe in his Buckinghamshire fastness replete with armed goons. The threat instead comes from Scotland, who would’ve thought?
Crabb has picked up where ids left off, it’s the bloody Tory government pulling the strings esp George Osborne. They all want bringing up on charges.
He thinks he’s slipped the net.
What happens to tyrants.?
I have been suggesting for a long time that disabled people bring a class action against the government. The DLA to PIP fiasco should be an easy one to start with….
IDS knows he’s guilty all of those people who lost their loved ones need justice and those two pair of low lifes to serve prison time
There will be an absence of documented evidence when courts order surrender of data from the DWP. Shredders have been working overtime. This is not necessarily a bad thing, as those (survivors & deal makers) involved in the reforms can offer their evidence, which because the DWP will be unable to counter, will carry more weight. This is going to end up massive where no one with dirty hands will escape, and nor should they.
