Travesty for justice as Tories win court case to ignore disabled people’s human rights

The case involved Jayson and Charlotte Carmichael.

Tory welfare chief Esther McVey has won a Bedroom Tax appeal against a man with a severely disabled wife.

The landmark Court of Appeal ruling is set to make it harder for benefits campaigners to challenge the government under the Human Rights Act.

Until this ruling, someone who believes a new government law is discriminatory didn’t have to go to the High Court.

Instead they could have it overturned in the social security tribunal using the Human Rights Act.

Following the ruling in favour of the Work and Pensions Secretary, disabled and unemployed people will now only be able to fight cuts on human rights grounds in the most expensive and intimidating courts in the land.

The case involved Jayson Carmichael, whose wife Charlotte has spina bifida.

[It] came after the Department for Work and Pensions challenged the methods they used to defeat the government.

This time – the second attempt by the DWP – the government has succeeded, although the Judge ruled that he would accept a further appeal from the Carmichaels.

    What gets me with all of these legal challenges or counter challenges by dwp is the way they abuse the public purse. Surely there has to be some kind of regulation or accountability to it all?? And if not then why the hell not!!!????

      The disability denying assessments, the tribunals the bogus back to work Work Support Providers are all paid out of the National Insurnace Fund which is being emptied. Bevan wanted it to build as a secure reservoir to secure everyones health and welfare for generations and could not be taken away or emptied as it was soo big

      It was one of the 3 national securties built after the war to secure the country, its prospects and everyone in it

      National Insurance Fund can only be used for health and welfare and for helping disabled get back to work, as it was just after the war.

      This is the weakness which they have been using, creating a bogus disability assessment scheme, contracted to private at millions and billions and go round and round and round

      Then there were the state pension funds which were built up and invested back into the country and the innovations, science, technology patented to the govt

      80% of investment was the pension funds so that builds up and secures

      some idiot persuaded Gordon Brown to riffle them and destroy them

      Then there was the build up of the gold reserve again there to be the nations security, not spend

      All being riffled

      It is a trick to empty the National Insurance Fund which was there to secure us all, including the economic stability of the country so it would not be destroyed or crashed on the whims of business or wideboy speculators and chance merchants.

      There was no economic crash since 1947 to 1973 (Opec Oil and changing the security from one based on gold to one based on currency)

      Its a way of removing our security, destoying our rights, bankrupting country and returning us to serfs and plebs, putting the hoi poloi back in their place as they said in 2008


      it is a way of transfering public money taxes and national insurance and our assets and resources to the corporate private sector. embezzlement by stealth.

        Last I heard, the National Insurance fund stood at more than £30 billion and was increasing, so I’d like to see your information for this.

    and I also am expected to turn up to court with no representation, no defence, all lawyers saying they will do no work and telling me I will be found GUILTY after telling me for years I have no rights as disabled, a woman, a tenant or as a working class person.

    For writing a true blog of how I lived as disabled tenant for years in unsafe home and severe abuse and harassment

    Sod that, at least I can write about it

    Have not got a clue what can be done, this country and its non existent ethics is going to the dogs.

    I have loads and loads of cases and testamonies of the lack of justice, failure of police, colluding of police in crime, abuse and discrimination and assault

    Its all backing up on me. a cloud or witnesses shouting and screaming

    They want justice and nobody hears.
