IS bride may face arrest if she comes to UK and begs courts to restore her citizenship

Shamima Begum: set to be arrested?

It seems Shamima Begum is likely to have her wish to live back in the UK after all – as a criminal serving a prison sentence for terror crimes.

The Home Office announced its disappointment that the Court of Appeal had allowed her to come home to beg for the return of her UK citizenship, and said it would appeal against the ruling.

Well, it seems someone has come up with this in the meantime.

Interestingly, a (non-scientific) poll of This Site’s readers has shown (at the time of writing) that roughly three-fifths of those who voted favoured returning her citizenship, against 40 per cent who did not.

So it seems she may have her citizenship restored – only to spend the next few years enjoying it in a prison cell.

Here’s LBC:

Richard Walton, who led Scotland Yard’s counter terrorism unit between 2011 and 2016, said that Shamima, now 20, who fled the UK as a schoolgirl to join IS in Syria, is likely to face arrest and a subsequent terror trial if she takes up the opportunity to return to the UK.

Mr Walton said he believes the appeal court had made a mistake in its judgement yesterday and that the ruling “undermines” the ability of elected officials to keep the public safe.

Mr Walton said: “I think the court of appeal has made a profound mistake. It will set a dangerous precedent.

“Frankly it is alarming to see the court of appeal taking over the Home Secretary’s responsibility of who should be allowed in the UK.

“It has opened the door for her return to Britain and has undermined a statutory power of parliament.

“She is highly likely to be arrested… but it is almost impossible to gather sufficient evidence from war zones.”

It seems to This Writer that, if Ms Begum is indeed arrested on her arrival in the UK, then it presents an opportunity for our security forces.

As a commenter on This Site’s previous story wrote: “If she was a child that was groomed, as some are saying, then we need to know who has been doing the grooming.”

Exactly. Let’s find out who has been encouraging teenagers to betray their country, track them down and bring them to justice.

I think that should be something we can all support.

‘Frankly it is alarming to see the court of appeal taking over the Home Secretary’s responsibility of who should be allowed in the UK.’

Reason why the Court of Appeal exists is to ensure Home Secretary’s do not engage in draconian criminal acts such as the Windrush scandal! This is why courts exist because they are supposedly independent of politics!

Do not forget the current Home Secretary puppet of the fascist tory regime is already threatening EU citizens with deportation and without any recourse to Appeal.

Meanwhile over 360 male terrorists or ‘Jihadis’ returned to the UK and were not prosecuted by Home Office and instead were given support!

So who are the criminals – not those 360 male terrorists but a young woman who was a child when male terrorists deliberately exploited her for their own ends!

But demonising Ms. Begum makes the fascist tories look as they are engaged in ‘national security’ – but in reality just another fascist tory red herring!

There is an ongoing campaign by the current Tory leadership, supported by the usual Tory papers , to undermine the function of judges and the Courts.
The Courts exist to make sure that elected politicians (and unelected Special advisors) don’t exceed their powers. So that we don’t get an “elected dictatorship” by politicians who are elected to power on a single popular issue, let’s say Brexit, and then cheerfully make up all kinds of other policies that may not even be lawful but which the politician just likes!
So the Home Secretary cannot make a decision about Begum based on her own opinion alone. Her decision has to be taken within the law and within the wording of the relevant Act. Patel cannot just decide to attract popularity by, say, announcing the execution of anyone who is accused of anti-semitism. Just because she is elected (by under 45% of the electorate ) doesn’t mean that she can then decide whatever she likes.
So, in this case, the law was investigated and it was found that Begum should be allowed to appeal the Home Sec’s decision.
This is denounced by right-wing journalists as the Judges undermining the elected politicians.
I see it as the Judges checking if the politicians are behaving lawfully.
I note that in Poland, the far-Right President and Parliament are working fiercely to remove power from the Judges so that they can push through their reactionary plans, without any checks as to whether they are allowed to do it by their own law or Constitution.

This theme of Right wing populists being elected on one or two popular issues and then using their power to achieve far more than they were ever elected to carry out, is becoming familiar all across Europe, not least here in Britain under Prime Minister Cummings.

Young people change so much between the ages of 15 and 20. At 15 she was clearly a child, and I believe that she was groomed or at least influenced by people who didn’t have her best interests at heart. As a 20 year old adult she may now view the world entirely differently.

I believe the age of responsibility and be tried as an adult is 12 or 14. She was 15. She knew what she was doing. She went to ISIS rallies with her father. Heads in baskets don’t bother her. She should not be allowed back in.
